Investing in Your Wife's or Child's Name in 2026: Clubbing of Income, Loans Instead of Gifts, Minor Child Rules and What Still Saves Tax

Money you give your wife or minor child and invest in their name is still taxed in your hands, but there are legal ways to spread family income.
Sureshbhai, a cloth merchant in Junagadh in the 30% bracket, has put Rs 40 lakh in fixed deposits in the name of his wife Neha, who has no income of her own. He has also bought shares in the name of his 12-year-old son and given Rs 10 lakh to his daughter-in-law to invest. He believes the interest and gains are tax-free because they are in family members' names, and has never mentioned them in his own return.
Putting investments in a wife's or child's name is one of the most common tax-saving ideas in Indian families, and one of the most misunderstood. The clubbing rules decide whose income it really is. Here is how they work in 2026.
Short Answer: Income from money or assets you give your wife, your daughter-in-law or your minor child is added to your own income and taxed at your rate, even if the investment is in their name. This does not apply to their own savings, to gifts made before marriage, to genuine loans at interest, or to income earned on the reinvested income. A minor child's income is taxed with the higher-earning parent, with Rs 1,500 a year exempt per child, but income from the child's own skill is not clubbed. Gifts to adult children and to parents are not clubbed, and tax-free schemes like PPF stay tax-free in any family member's name.

Gifts to your spouse
- The rule: income from money or assets transferred to your spouse without adequate consideration is taxed in your hands.
- Interest, rent and gains: FD interest, rent from a flat and capital gains on shares bought with your gift are all clubbed.
- Income on income: once the first year's interest is reinvested, the income on that reinvested amount is your spouse's.
- Not clubbed: your spouse's own earnings and savings, gifts from her parents, and gifts made before marriage. Keep the records.
- Gift tax: gifts between spouses are not taxed as income, but clubbing still applies. See is a gift taxable.
Loans instead of gifts
- A genuine loan: money lent to your spouse at a reasonable interest rate, with documents and actual interest payments, is not a gift.
- The result: the income on the investment is your spouse's, while the interest you receive is yours.
- Keep it real: a written agreement and interest paid through the bank every year support it.
Salary to your spouse
- The rule: salary paid by a business in which you have a substantial interest to your spouse is clubbed with your income.
- The exception: not clubbed if the spouse has a technical or professional qualification and the salary is for that work.
- In practice: pay a reasonable salary for real work, with attendance and duties on record.
Minor children
- The rule: a minor child's income is added to the income of the parent whose income is higher.
- Exemption: Rs 1,500 a year per child is exempt.
- Not clubbed: income from the child's own manual work, skill or talent, and income of a child with a specified disability.
- At 18: from the year the child becomes a major, the income is the child's own.
- Shares in a child's name: dividends and gains are clubbed until then. See tax on shares and mutual funds.
Other relatives and family structures
- Daughter-in-law: income from assets you give your son's wife is clubbed with your income.
- Adult children and parents: gifts to them are not clubbed. Income on the gift is theirs, taxed at their rate.
- HUF: property an individual member transfers to the HUF is also covered by clubbing. See HUF in 2026.
- Tax-free investments: PPF and Sukanya Samriddhi interest is exempt, so clubbing makes no difference.
Reporting it right
- Your return: show the clubbed income in your return under the right head.
- TDS in their name: tax deducted on FDs in your spouse's name needs care so the credit follows the income.
- Either regime: clubbing applies under both the old and the new tax regime.
Back to Sureshbhai. The interest on the Rs 40 lakh of FDs is clubbed with his income, so it is added to his returns, and the TDS credit is aligned with the deductor. Future savings for Neha are given as a documented loan at interest, so the income on them is hers. The shares in his son's name stay clubbed until the boy turns 18, the Rs 10 lakh to his daughter-in-law is clubbed too, and new family investments go into PPF for Neha and into gifts to his retired parents, whose income is below the taxable limit.
