Gaushala and Panjrapole Trusts in Gujarat 2026: Tax Exemption, 80G for Donors, Donation Boxes, Grants, GST on Milk and Manure, and CSR Funds

A gaushala or panjrapole trust stays tax-free and can give donors 80G receipts, if it is registered, spends 85% of its income and files on time.
A panjrapole near Keshod looks after 900 cattle, many of them old or abandoned. It collects donations at festivals and through donation boxes, receives a state grant for the animals, and sells milk from a few cows and dung manure to farmers. Donors in Mumbai and Surat now want 80G receipts, but the trust's income tax registration lapsed when the re-registration of 2021 was missed.
Saurashtra has hundreds of gaushalas and panjrapoles, run by devoted trustees with little time for paperwork. The tax law supports them well, but only when registration, donor records and filings are kept in order. Here is how it works in 2026.
Our team handles registration, 80G, audits, returns and donor filings for gaushalas and animal welfare trusts. Call or WhatsApp +91 82005 28355, or see the details at the end of this guide.
Registration comes first
- Charitable purpose: care and protection of animals is treated as a charitable purpose.
- Income tax registration: provisional for three years for a new or re-applying trust, then regular for five years, renewed before expiry. Without it, the trust's income is taxed.
- Missed 2021 re-registration: older registrations had to be revalidated in 2021-22. A trust that missed it should apply afresh now. See 12A and 80G registration and renewal.
- Charity Commissioner: the trust must also be registered under the Gujarat Public Trusts Act. See trust registration in Gujarat.
80G for donors
- The deduction: donors usually get 50% of the donation as a deduction, within limits, and only under the old tax regime.
- Cash limit: cash donations above Rs 2,000 do not qualify.
- Trust's filing: a statement of donations by 31 May and a certificate to each donor, or donors lose the deduction. See 80G claims and Form 10BE.
- Collect details: name, address and PAN of every donor who wants 80G.
Donation boxes and anonymous donations
- The rule: for a charitable trust, anonymous donations above the higher of Rs 1 lakh or 5% of total donations are taxed at 30%.
- Reduce the risk: issue receipts with names wherever possible, and encourage UPI and bank donations.
- Counting: open boxes in front of at least two trustees, record the amount and bank it the same day.
- Large cash gifts: no trust can accept Rs 2 lakh or more in cash from one person. See cash transaction limits.
Grants, milk and manure
- Government grants: part of the trust's income, exempt when spent on its objects, and not subject to GST.
- Fresh milk: exempt from GST.
- Dung and manure: unbranded manure not packed in unit containers is exempt; branded or packed products can be taxable.
- Panchgavya products: items sold as ayurvedic products carry GST at their own rate.
- Separate books: a dairy or product sale run alongside the trust's work should be incidental to its objects, with separate accounts.
Spending, audit and returns
- 85% rule: at least 85% of each year's income must go on the animals and objects, including fodder, medicine, staff and new sheds.
- Accumulation: money set aside for a specific project, such as a new shed, can be kept for up to five years with a filing.
- Audit and return: audited accounts and the return every year, on time. See trust and NGO annual compliance.
- Charity Commissioner: audited accounts and change reports are also filed in Gujarat. See temple and religious trusts.
CSR funds for gaushalas
- Eligible activity: animal welfare is listed among the activities companies can fund from their CSR budgets.
- What companies check: CSR-1 registration, income tax registration and 80G, and a track record. See getting CSR funding for your NGO.
Back to the panjrapole near Keshod. It applies afresh for income tax registration and 80G, and keeps its Charity Commissioner registration current. Donation boxes are opened before two trustees and banked the same day, and festival donors are given named receipts, most paid by UPI, keeping anonymous collections within the limit. The state grant and the milk and manure sales are recorded separately, with no GST due. Its accounts are audited, the return is filed on time, the statement of donations goes in by 31 May so every donor gets a certificate, and a CSR-1 registration opens the door to company funds for new sheds.
