In Gujarat, shops with fewer than 20 workers now need only an online intimation, but professional tax registration applies to almost every business.

A young couple opens a bakery cafe in Junagadh with six staff. They take an FSSAI number and GST, because the delivery app asks for both. Nobody mentions the shop intimation or professional tax. The first reminder comes from the bank, which wants a shop and establishment certificate before it opens the current account. The second comes two years later, as a professional tax demand with interest.

Neither registration is difficult or costly. They are just easy to miss. Here is what a new shop, office, clinic or restaurant in Gujarat has to do in 2026, including what changed this year.

In short: Under the Gujarat Shops and Establishments Act, 2019, as amended in 2026, an establishment with 20 or more workers must register within 60 days of starting, and one with fewer than 20 workers must file an online intimation within the same time. The certificate stays valid until the ownership or the nature of the business changes. Professional tax is separate: every employer must register and deduct Rs 200 a month from each employee earning more than Rs 12,000, and every business or professional must enrol and pay a yearly tax by 30 September. In Gujarat, professional tax is collected by the local body, that is, the municipal corporation, municipality or panchayat.

Who is covered by the Shops and Establishments Act?

Almost every commercial place that is not a factory: shops, offices, showrooms, godowns, hotels, restaurants, clinics and professional offices, coaching classes, salons and theatres. It does not matter whether the business is a proprietorship, firm, LLP or company, or whether it has GST.

Registration or intimation?

  • Fewer than 20 workers: an online intimation with a self-declaration and basic documents, within 60 days of starting. You get an intimation receipt.
  • 20 or more workers: an application for registration within 60 days, with a small fee. You get a registration certificate.
  • No yearly renewal: the certificate stays in force until the ownership or the nature of the business changes.
  • Changes and closure: a change in particulars must be reported, and a closure must be intimated within 30 days.

Until 2025, the dividing line was 10 workers. An ordinance in December 2025, made permanent by the Amendment Act notified in February 2026, raised it to 20. So most small shops and offices now need only the intimation, which is done online on the eNagar portal in municipal areas.

What else changed for employers in 2026?

  • Working hours: up to 10 hours a day, within the same limit of 48 hours a week.
  • Rest: a break after not more than 6 hours of continuous work.
  • Overtime: paid at double the wages, up to 144 hours in a quarter.
  • Women at night: women can work between 9 pm and 6 am with their consent, and with transport and safety arrangements provided by the employer.

Why does it matter for a small shop?

  • Banks ask for the shop certificate or intimation receipt to open a current account or sanction a loan.
  • It is the simplest proof that the business exists at that address, useful for other licences, tenders and payment gateways.
  • Running an establishment that needs registration without it carries a penalty of Rs 10,000.

Professional tax in Gujarat: two certificates

Professional tax catches more people off guard than the shop law, because it applies even to a one-person business.

  • Enrolment certificate: for the business or professional itself, such as a trader, doctor, consultant, firm or company. Apply within 60 days of starting. The tax is a fixed yearly amount that depends on the category and turnover, and it can never be more than Rs 2,500 a year. It is paid by 30 September each year.
  • Registration certificate: for an employer. Apply within 60 days of becoming liable. Deduct Rs 200 a month from every employee whose monthly salary is above Rs 12,000, and nothing from those earning up to Rs 12,000.
  • Payment by employers: monthly, by the 15th of the next month, for employers with more than 20 employees, and quarterly for smaller employers.
  • Where: with the local body where the business is located: the municipal corporation, the municipality or the panchayat.
  • If you are late: interest at 18% a year on unpaid tax, and a penalty.

An example: the bakery cafe has six employees, four of them earning more than Rs 12,000. The owners deduct and pay Rs 800 a month for those four, in quarterly instalments, and pay their own yearly enrolment tax by 30 September.
